Family says tabloid's grown-up Dugard pic isn't her

The National Enquirer had a scoop last week when it ran what it billed as the first photograph of an adult Jaycee Dugard, the 29-year-old woman who was freed last month after being held for 18 years in a backyard compound near Antioch.


The problem? According to Dugard's family, the glamour shot of a young woman in a 1980s-era jean jacket -- splashed across the top of the tabloid's front page -- is of somebody else.

"The family flatly, emphatically states that it is not her, not even close," said Erika Price Schulte, a family spokeswoman.


"Frankly," she said, "I think it's horrendously irresponsible to run something like that. Either it's inaccurate or, if it was her, you'd be identifying the victim of a sex crime against her wishes. I have an issue with it either way. It's a no-win."



According to police, Dugard was grabbed from a South Lake Tahoe street in 1991 by Phillip Craig Garrido and his wife, Nancy Garrido. Eventually, authorities say, Dugard became known as "Alissa" and had two of Phillip Garrido's children. The Garridos have pleaded not guilty to kidnapping and rape charges.



In recent years, Dugard helped Phillip Garrido with his printing business, customers say. Ben Daughdrill of Oakley, a customer who says he met Dugard on a few occasions, was also shown the photo in the National Enquirer.


"Not even close!" Daughdrill said in an e-mail message. "I'm positive that's not her. No way."


A caption in the Enquirer said the photo was from the back of one of Garrido's business cards. "The striking blonde pictured on the back of it was introduced to barber Thompson as Garrido's daughter Alissa," the caption says.


Thompson is Wayne Thompson, owner of Wayne's Barbershop in Pittsburg.


Although the Enquirer has a policy of paying sources for stories, Thompson said he had given the card to the tabloid for free. He said he hadn't seen Dugard in recent years and had told the Enquirer as much.


"I was told it was her by Phillip," Thompson said. "He said he put his daughter's picture on the card to show what he could do with photos."


Asked if the Enquirer had printed the wrong photo, Patricia Shipp, a reporter for the paper assigned to the Dugard story, said, "That's not what we understand."


She said the Enquirer had confirmed that the photo was accurate. "That's why we ran it," she said.


She referred further questions to her editor, Larry Haley, who did not immediately return a call seeking comment.

Garrido Sends Jailhouse Letter To KCRA
Jaycee Lee Dugard's Alleged Abductor Held In El Dorado County

SACRAMENTO, Calif. -- KCRA 3 received a letter Wednesday from Phillip Garrido, the convicted rapist accused of abducting Jaycee Lee Dugard nearly two decades ago from her home near Lake Tahoe.
Garrido remains in custody at the El Dorado County Jail in Placerville as he and wife Nancy Garrido await trial on multiple charges each. They've pleaded not guilty.

The envelope, written in pencil, was sent to KCRA 3's studios in downtown Sacramento. Garrido had written his name in the upper-left corner as the sender, over which was stamped "County of El Dorado, Jail Division," with the jail's address. A spokesman with El Dorado County said it appears authentic.

Garrido Says Dugard's Rights Violated
Phillip Garrido Writes Jailhouse Letter To KCRA

SACRAMENTO, Calif. -- Phillip Garrido, the convicted rapist accused of kidnapping Jaycee Lee Dugard more than two decades ago, alleges her civil rights have been violated and asked KCRA 3's Walt Gray to contact Dugard at the "earliest possible date."

Garrido remains in custody at the El Dorado County Jail in Placerville as he and wife Nancy Garrido await trial on multiple charges each. They've pleaded not guilty.

In a jailhouse letter sent to Gray, Garrido claimed Dugard's "free speach [sic] rights are being violated."

He also alleged Dugard was "repeatedly denied access to have an attorney present during questioning. Over & over she clearly expressed this request from the beginning to the conclusion of questioning."

"Please concider [sic] this request to contact her at your earliest possible date," Garrido wrote.

Gray went inside the jail Wednesday to see if Garrido would explain the contents of his letter. Garrido told jail staff to tell Gray he would not meet unless his attorney was present.

The attorney, Public Defender Susan Gellman, arrived shortly after having been alerted by jail staff that Gray was attempting to interview Garrido. KCRA 3 had contacted Gellman earlier to tell her Gray was trying to speak with her client.

Gellman also said the case has a long way to go and wanted it to play out in court.

Bill Clark, chief assistant district attorney in El Dorado County, said Garrido has access to television and periodicals in jail and knows what's happening with the case.

Dugard's Attorney Has No Comment

McGregor Scott, a former U.S. attorney representing Dugard, was read the full text of the letter Wednesday. He declined to comment on it.

At a news conference last week, Scott said his client has mixed emotions surrounding the arrest of her alleged captors, but realizes "some bad and terrible things were done to her."

"I devoted almost two decades of my life to law enforcement in this state and we failed. We failed Jaycee Dugard and her family. And I think we need to own that," Scott said.

Dugard was 11 when police said Phillip and Nancy Garrido kidnapped her in Meyers, then allegedly held her captive for 18 years in a hidden, backyard compound in Antioch, Calif.

"It's a disgusting thing that took place with me at the beginning. But I turned my life completely around and to be able to understand that, you have to start there," Garrido said in a jailhouse phone call with Gray shortly after his arrest Aug. 27.

The case broke in late August after Garrido was spotted with two children as he tried to enter the University of California, Berkeley, campus to hand out religious literature. The officers said he was acting suspiciously toward the children. They questioned him and did a background check, determining he was a parolee, and informed his parole officer.

Garrido was ordered to appear for a parole meeting and arrived with Dugard, his wife and two children. During questioning, corrections officials said he admitted kidnapping Dugard.

Bail for Phillip Garrido is set at $30 million, but because of a parole hold, he is not eligible for release, El Dorado County District Attorney Vern Pierson said.

Nancy Garrido is being held without bail.

Both are due back in court for an Oct. 29 hearing.

Garrido's Parole Supervision Falls Under Scrutiny

The state Office of the Inspector General is conducting an independent investigation into how the California Department of Corrections and Rehabilitation handled Phillip Garrido's parole supervision, KCRA 3 has learned.

The inspector general is responsible for independent oversight of corrections.

"We're taking a look at the systemic issues related to the parole supervision of Mr. Garrido," state Inspector General David Shaw said. "And also the particulars of that case and we'll be doing a public report at the end of it."

Shaw said in an initial screening of the case, it did not look like there was any criminal conduct by anyone from corrections.

However, given the story that has developed, the inspector general initiated the independent investigation.

Shaw said as part of the investigation, his office has requested and received Garrido's parole file.

KCRA 3 has formally requested to review or obtain copies of records from the Garrido parole file, but CDCR has denied those requests.

Shaw said his investigators had also been "on the ground" with a search warrant team, walking through the Garrido residence, back yard and outbuildings in Antioch.

The Jaycee Dugard Kidnapping
In 1992, an anonymous caller told police he saw a girl who looked like kidnap victim Jaycee Dugard inn a gas station in Oakley, Calif., The San Francisco Chronicle reported. The man said the girl got into a yellow van, possibly a Dodge. Such a vehicle was found on the property of accused kidnappers Phillip and Nancy Garrido -- just two miles from the gas station
The caller said the girl got into a yellow van, perhaps a Dodge, but did not give any information as to the direction she traveled or who she may have been with.
Police say the home of Phillip and Nancy Garrido, where Dugard was allegedly held captive for 18 years, is located just two miles from the Chevron station in question. A yellow Dodge van was also recovered at the Garrido property.
In response to the man's tip, the Contra Costa County Sheriff's Office sent a deputy to the Chevron station. Police said the caller did not remain to be interviewed and left no contact information. With no license plate number or further leads, nothing came of the reported sighting, the newspaper said.
In 2006, police sent a deputy to the Garridos' home in response to a a neighbor's complaint that "little girls and women" were living in the squalid backyard. But the deputy left the residence after issuing a warning over code violations.
The sheriff's department has apologized for that missed opportunity.
Dugard walked into a police station this summer, nearly two decades after she was abducted. She was accompanied by her two daughters, who police say were fathered by Phillip Garrido. Both Phillip and Nancy Garrido are being held on charges including kidnapping and rape.

(CNN) -- Jaycee Dugard will testify against the couple that allegedly held her captive in an elaborate compound hidden in their backyard for 18 years if there is a trial, a lawyer for her family said at a news conference Thursday.

Attorney McGregor Scott admitted it has been a difficult transition for Dugard and her two children -- who police say were fathered by her captor -- given her captivity spanned more than half her life and was the only world she knew for so long.

"But there is no question that she knows that terrible and wrong things were done to her and that those people must be held accountable," Scott said.

Scott said he had no idea when a trial would be set for Phillip and Nancy Garrido, who have both pleaded not guilty to charges relating to Dugard's alleged kidnapping and subsequent abuse.

He acknowledged Dugard would have to relive the "trauma" in court by sharing the "very, very sordid tale."

Scott also said that because of Phillip Garrido's previous criminal history, which includes a kidnapping and rape charge for which he was registered as a sex offender, Garrido would automatically receive a sentence of 25 years to life if he were found guilty on only one felony charge.

But Scott said the family is trying not to focus on any of that and instead work on building a new life together. He said he had met with Dugard and her family twice for a couple of hours and was happy to see "how well they had been doing."

"Even more encouraging was the second time I met with them, I saw progress," he said.

"I'm just very pleasantly surprised watching the dynamics, and I think it's a very positive thing going forward."

Scott said Dugard's daughters, who police said never went to school or a doctor, were receiving tutoring. Dugard has been participating and observing.

"This is a woman whose [own] formal education ended in the fifth grade," he said. "She has a brain that she wants to develop, so it's a very positive thing."

The family received medical attention and counseling beginning the day Dugard and her children were discovered, Scott said. He also said they had received donations of more than $100,000 from the public, which would help the girls as they get older.

He praised law enforcement and family members for helping protect Dugard and her children after her discovery.

"[They are] very guarded in allowing the girls access to TV news, Internet, etc.," he said. "Because they're being a mother, a grandmother, protecting the girls from too much information too early."

He said he knows there is a curiosity about where the family is, but pleaded that the public and the media give the family time to heal.

More than anything, Scott said, Dugard's family is working to make life as normal as possible and allow them to make up for lost time.

"To watch the interaction between Jaycee and her mother ... after 18 years is remarkable," Scott said. "The emotions there, I think they're still wrestling with all of that but I think they're making great progress."

Jaycee Lee Dugard, Missing For 18 Years, To Issue Statement

SACRAMENTO, Calif. -- People magazine will release the first adult photo of Jaycee Lee Dugard early Wednesday morning on its Web site.



This photo of Jaycee Lee Dugard was taken prior to her 1991 kidnapping.


Erika Price Schulte, a spokeswoman for Dugard's family, told KCRA 3 that Jaycee Dugard wanted to do this in the most respectful way possible as a way to thank everyone for their outpouring of support.

Dugard was 11 years old in June 1991, when she was kidnapped while walking to a bus stop near her home in Meyers, Calif.

Now 29 and the mother of two, she surfaced last month in the Bay Area, where she was kept in a back yard for 18 years.

Phillip and Nancy Garrido, who are accused of abducting Dugard, remain in jail in Placerville.

Dugard will also have a statement printed in People magazine, Schulte said.
