SBI to probe possible DSS cover-up in girl's death


Fayetteville, N.C. — Cumberland County District Attorney Ed Grannis and Fayetteville Police Chief Tom Bergamine have asked the State Bureau of Investigation to look into whether social workers have turned over all of their records in the death of 5-year-old Shaniya Nicole Davis.

The girl was reported missing from her Fayetteville home on Nov. 10. Her body was found in a patch of kudzu off a rural road near the Lee-Harnett County line six days later.

She died of asphyxiation, according to preliminary autopsy results.

Mario Andrette McNeill, 29, of 2613 Pine Springs Drive, has been charged with first-degree murder, first-degree rape of a child and first-degree kidnapping in the case. Police have characterized him as a family acquaintance.

Shaniya's mother, Antoinette Nicole Davis, 25, has been charged with human trafficking, felony child abuse–prostitution, filing a false police report and obstructing a police investigation. Arrest warrants state that Davis "did knowingly provide Shaniya with the intent that she be held in sexual servitude" and "did permit an act of prostitution with Shaniya."

The Cumberland County Department of Social Services previously looked at Davis with regard to her 7-year-old son, not Shaniya, according to her uncle, Michael Davis. The case was closed, and Antoinette Davis was able to retain custody of the boy, her uncle said.

DSS Director Brenda Jackson has declined to comment on the agency's involvement with the Davis family, citing the investigation into Shaniya's death as well as confidentiality rules for child protective services cases.

Grannis sent a letter Friday to Cumberland County Manager James Martin to notify him that he and Bergamine have requested an SBI investigation of DSS.

"Chief Bergamine has requested the SBI's assistance to determine if Fayetteville police have received complete and accurate records from Cumberland County DSS regarding this case," Grannis wrote. "Based upon the information provided to me and my senior staff by the Fayetteville Police Department concerning these issues, I share their concern, and I have requested the assistance of the SBI to assist us in this regard."

In a statement released by Cumberland County spokeswoman Sally Shutt, Jackson said she would ensure that her office cooperates with authorities to resolve the matter.

Authorities with the state Child Fatality Task Force already are looking into any DSS contact with the Davis family. The task force studies all child deaths in North Carolina to make recommendations to legislators on changes to state laws and administrative polices to prevent future deaths.

Lawyer for Shaniya Davis' accused killer withdraws from case
The man accused of killing 5-year-old Shaniya Davis will be assigned a new lawyer.
Mario Andrette McNeill had been represented by Fayetteville lawyer Allen Rogers.

During a brief court appearance today, Rogers withdrew from the case and McNeill was told a lawyer from the North Carolina Office of the Capital Defender would be assigned to the case. The office handles capital cases for the indigent.

Rogers said the state defender office could provide McNeill more resources to work the case than he could.

McNeill, 29, of the 2600 block of Pine Springs Drive is charged with first-degree murder, first-degree rape and kidnapping.

Shaniya was taken from her mother's home in the Sleepy Hollow Mobile Home Park on Nov. 10. Video surveillance captured images of her that morning being carried into a Sanford Hotel by McNeill.

Six days later, her body was found in woods off N.C. 87 between Fayetteville and Sanford.

Shaniya's 25-year-old mother, Antoinette Davis, is charged with human trafficking, child abuse involving prostitution, filing a false police report and obstructing an investigation.

McNeill's next court date is set for Jan. 27.

Search warrants in the case were unsealed this week by a Cumberland County Superior Court judge. According to an affidavit attached to one warrant, Detective Jason Sondergaard "observed photographs of a sexually explicit nature, and some of the photographs appeared to be that of a female juvenile under 10 years of age."

The warrant says Sondergaard contacted a doctor who specializes in developmental and forensic pediatrics to help identify the approximate age of the girl in the photographs. A precise age could not be determined, but the doctor confirmed that the explicit photos were of a young black girl.

Brother's statement

In an affidavit for another search warrant, written by Detective Terrance Phillips, investigators say they interviewed Shaniya's 7-year-old brother the day Shaniya was reported missing.

The child told detectives that he saw a black man with dreadlocks whom he did not recognize inside the home. He said he heard loud stomping noises, then went to sleep.

The affidavit says none of the adults in the residence mentioned the man with dreadlocks. McNeil, who was not linked to the case until the surveillance video was uncovered at the Sanford motel, had dreadlocks at the time of his arrest.

According to the warrants, investigators seized numerous items, including computer data from the various electronics; clothing that could fit a young child; soil samples; a plastic straw; and swabbings from a 1997 Mitsubishi Galant belonging to McNeil.

A report from an autopsy on Shaniya's body concluded that her injuries were consistent with a sexual assault. The report, by the N.C. Office of the Chief Medical Examiner, lists asphyxiation as the likely cause of death.
A medical examiner's notes say Davis "reportedly owed money to McNeil and offered the daughter in exchange for forgiveness of her debt."

The State Bureau of Investigation is involved with the case at the request of District Attorney Ed Grannis. Grannis asked the SBI to look into record-keeping at the Cumberland County Department of Social Services, which had been involved with Antoniette Davis and her children before Shaniya's death.

Shaniya's mom makes bail

The mother of 5-year-old Shaniya Davis has posted bail and been released from jail, according to the Cumberland County Sheriff's Office.

Antoinette Davis, 25, was released Sunday after posting a $51,000 bail, said Debbie Tanna, a spokeswoman for the Sheriff's Office.

Davis is charged with human trafficking and child abuse involving prostitution after her daughter's body was found in Lee County woods on Nov. 16, six days after she was reported missing from her home in Fayetteville.

Mario Andrette McNeil, 29, is charged with first-degree murder and first-degree rape of a child in Shaniya's death.

Surveillance video from a hotel in Sanford showed McNeil carrying the child into an elevator and leaving about an hour later.

Davis had been held at Central Prison in Raleigh, but Tanna said Cumberland County deputies were ordered to bring Davis back to Fayetteville and release her.

Her bond was posted by Accredited Surety and Casualty Co. Inc.

The local agent, Julius D. Robinson, declined to comment on Davis' bond.

Bondsmen require the defendant or the family to put up anywhere from 5 percent to 15 percent of the bond in collateral, including cash and property.

Davis' lawyer, D.W. Bray, would not say what her family used for collateral.

Bail is designed to ensure someone who has been charged will appear in court, according to Bray. He said his client is presumed innocent.

The U.S. Supreme Court has ruled that bail cannot be used as punishment, he said.

That Davis posted bail is "standard practice," Bray said.

"This isn't unusual," he said.

Davis is scheduled to appear in District Court on April 15.

Shaniya Davis Case Update: Antoinette Davis is Released From Jail

When posting bond of this magnitude in a case this intense the authorities usually take precautions to assure no one takes off, including house arrest. Whether or not Antoinette Davis is on house arrest has not been released. But it is most likely.

Antoinette Davis is scheduled to return to 2B at the Cumberland Courthouse on April 15, 2010 according to Cumberland County Courthouse records.

Shaniya Davis’ mother, Antoinette Davis has been charged with human trafficking, filing a false police report, felony child abuse/prostitution, and obstruction of police. People were shocked, however, that with all of the charges against Antoinette that she was released from the North Carolina Correctional Institution for Women on a $51,000 bond. She will appear in court on April 15, 2010.


An Amber Alert had been issued for Shaniya Davis, but it was soon discovered that Shaniya had not been abducted like her mother, Antoinette Davis claimed, but rather Antoinette sold Shaniya to the man now charged with her rape and murder: Mario McNeill.


An autopsy had revealed that little Shaniya, only 5-years-old, had been raped before she was murdered; she died from asphyxiation. The case has drawn light to a horrific crime: child prostitution and sex slavery.


Shaniya Davis’ aunt, Corey Lockhart-Davis was outraged that Antoinette Davis has been released from jail. She spoke out to WRAL. You may see the interview in the video player below.
