Police search for boy, dad accused in slayings

Joe Marin, 23, was last seen with his son, Jaiden, on Wednesday.

Police are searching for a 4-year-old boy believed to be with his father, who is wanted in connection with a Stafford ice house shooting that left two people dead and four others injured.

Joe Marin, 23, went to the store on Wednesday with his son, Jaiden, and did not return, authorities said.

The child’s mother, Marin’s girlfriend, reported the disappearance early Friday.

Stafford police have said four people, including Marin, are responsible for the Dec. 18 shooting at the Stafford Ice House, 3230 South Main.

Holding on tightly to a picture of a missing child, a family asks why authorities won't issue an Amber Alert for a little boy they say was taken by his father -- a man charged with capital murder.

The family was fighting back tears when we talked to them on Christmas Eve. Their four-year-old son has been missing for days, and the man they believe took him was his father, a wanted fugitive accused in a double murder in Stafford.

The search for the suspects in the Stafford Ice House shooting certainly took another turn Friday when we learned that one of them has a four-year-old son he apparently took from the boy's mother without permission three days after the deadly shootings. Now, the mother's family is now frantic to get him back.

Jaiden Marin disappeared with his father, 23-year-old Joe Marin, on Tuesday.

Jaiden's mother says she and Marin, her ex-boyfriend, had just given Jaiden a new Spiderman bicycle for Christmas. She says Jaiden and Marin were outside together with the bike when his mother says suddenly Marin put Jaiden in his car and left.

Jaiden's maternal grandmother, who is afraid for her own safety, wants Jaiden back.

"My Jaiden is -- he's four years old, and he's a very, very happy baby," his grandmother said.

Joe Marin is one of four men wanted for a deadly shooting outside the Stafford Ice House a week ago. Two people were killed and four more were hurt in a violent dispute. They were charged Thursday, and now Jaiden's grandmother fears for the four-year-old boy who has unopened presents waiting for him under the tree.

"My biggest concern is that Jaiden is in danger, or that we're not going to see Jaiden. And that's all we want is we want Jaiden back," his grandmother said.

But because Marin shares custody of Jaiden, and because he's never posed a physical threat to the child before, neither Houston nor Stafford police will issue an Amber Alert. It's considered a custodial issue. Stafford police calling Joe Marin and the others both armed and dangerous does not make a difference.

It's frustrating for Jaiden's aunt, who hopes Marin will stop hiding with his son.

"Please do the right thing and know that Jaiden is where he belongs when he's with us," his aunt said. "Please do the right thing and bring Jaiden back to us."

Suspect (Michael Marin surrendered) in bar shooting turns himself in~
STAFFORD, TX (KTRK) -- Fort Bend County Sheriff deputies have arrested one of several family members wanted in connection with a deadly shootout at an ice house in Stafford earlier this month. Only Eyewitness News was there when Michael Marin surrendered.

Without stopping to answer our questions, capital murder suspect Michael Marin walked into the Fort Bend County Sheriff's Office to meet with his attorney. Marin is one of four suspects wanted in a double murder at the Stafford Ice House on December 18. Four others were also wounded in that shooting.

Defense attorney Don Hecker said, "Our position is, is he didn't participate at all."

Hecker says Marin has been isolated in hiding since the shootings, originally, he claims, because of death threats Marin received following the murders. Hecker says his client told him he does not know where the other suspects are.

Marin wouldn't tell us where he's been or why he decided to surrender to authorities today. His attorney says Marin claims that on the night of the murders, Marin never had a gun and never fired one.

Authorities say the shootings were the culmination of a violent dispute among family members and friends at the ice house. One group was kicked out of the bar. Investigators say they returned and at least one person began shooting as they went back into the bar.

Michael Marin wouldn't spell out for us what happened that night. He's been booked on a charge of capital murder that his attorney calls "ridiculous." The DA says it's a charge possible even if Marin never held a gun.

Fort Bend District Attorney John Healey said, "In this case the allegation is that the killing took place in which two people were killed during the same criminal transaction."

Healey has not yet decided if he will seek the death penalty against Michael Marin. Marin remains in custody at the Fort Bend County Jail with his bond set at $200,000. He is scheduled to appear before a magistrate court in Fort Bend County Tuesday morning.

UPDATE -- Brothers Joe and Tony Marin turned themselves in to the Fort Bend County Sheriff's Office this afternoon. They are being held in Fort Bend County Jail. Joe Marin had his son with him. The boy was returned safely and reunited with his mother. The fourth suspect, Fransisco Marin, remains at large. Michael Marin turned himself in to authorities Dec. 23.
STAFFORD (Dec. 23, 2010) -- Stafford police issued capital murder warrants for four Stafford men, who are related. Police believe they were involved in a shooting that killed two people and wounded another four at The Stafford Ice House off South Main.
Police said the men are all Fort Bend County residents. They consider them armed and dangerous. We found out this is not the first brush some of them have had with the law.
Saturday morning, the scene at the Stafford Ice House was pure chaos. After words were exchanged between two groups, two people were shot dead and four sent to the hospital.
Minerva Benavides' nephew, Oscar, was one of those killed. She said he was simply in the wrong place at the wrong time.
"I wish I could tell you more," she said. "All I know he was shot and so were a lot of other people."
Today the scene at the ice house was quiet and only full of bar regulars in what police say is a normally quiet place in a quiet town.
"Anytime there is a murder, anytime there is violence like this, it's a surprise," Detective Raphael Virata of the Stafford Police Department said.
Thursday, police released images of the suspects they believe are involved in the shooting. Officials said they are all family members from the Stafford area.
According to law enforcement, Francisco, Joe and Tony Marin have had previous brushes with the law ranging from misdemeanor assault, marijuana possession and evading arrest.
Only Michael Marin has not been arrested in the past.
The four face capital murder charges, the most serious possible. Fort Bend County Crime Stoppers is offering $5,000 for information that leads to the arrest and conviction of each suspect.
Until then, police must battle rumors flying through the small town about what happened that night that lead to the deadly argument.
"One of the big obstacles we are having now is we are trying to get a hold of everybody that was there that might have seen something to come in and talk with [us]," Virata said.
